The legal system must be fair and just from "summary" of Crime Without Punishment by John L. McClellan
The fundamental principle that guides our legal system is the idea that justice should be fair and impartial. This principle is the bedrock upon which our entire system of laws and regulations is built. Without fairness and justice, our legal system would crumble to the ground, leaving chaos and confusion in its wake. In order for the legal system to be fair and just, it must be based on a set of clear and objective rules that apply to everyone equally. These rules must be consistently enforced, without favoritism or bias. If the rules are unclear or subject to interpretation, then the system becomes arbitrary and capricious, with outcomes that are unpredictable and unreliable. Furthermore, the legal system must provide due process to all individuals who come into contact with it. This means that everyone is entitled to a fair trial, legal representation, and the right to present evidence in their defense. Without due process, the legal system becomes a tool of oppression and tyranny, rather than a mechanism for justice. In addition to being fair and just, the legal system must also be transparent and accountable. This means that decisions must be made openly and in accordance with the law, and that those who administer justice must be held to account for their actions. Without transparency and accountability, the legal system loses the trust of the public and becomes a source of corruption and abuse.- The goal of our legal system is to ensure that justice is done and that individuals are treated fairly and equitably under the law. Without fairness and justice, the legal system loses its legitimacy and its ability to uphold the rights and freedoms of all individuals. It is only by adhering to these principles that our legal system can fulfill its essential role in society and maintain the rule of law.
